Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Lumaqi PowerSync mobile application (the "Service") operated by Lumaqi ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

Lumaqi PowerSync is a mobile application that enables users to automatically synchronize and backup content from their device to Google Drive. The Service acts as a conduit between your device and Google Drive, facilitating direct file transfers.

3. User Accounts

To use the Service, you must:

Have a valid Google account
Grant the Application permission to access your Google Drive
Provide accurate and complete information during setup
Maintain the security of your account credentials

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User Responsibilities

You agree to:

Use the Service only for lawful purposes and in accordance with these Terms
Not use the Service to transmit any malicious code, viruses, or harmful data
Not attempt to gain unauthorized access to any portion of the Service
Not interfere with or disrupt the Service or servers connected to the Service
Comply with all applicable local, state, national, and international laws
Ensure you have the right to sync and backup the content you choose to sync

5. Google Drive Integration

The Service integrates with Google Drive through the Google Drive API. Your use of Google Drive is subject to Google's Terms of Service and Privacy Policy. We are not responsible for Google's services, policies, or actions.

The Service only accesses files and folders that you explicitly authorize. You can revoke the Application's access to your Google Drive at any time through your Google Account settings.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Lumaqi and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding:

The reliability, availability, or uptime of the Service
The accuracy, completeness, or timeliness of data synchronization
The compatibility with all devices or operating systems
The absence of errors, bugs, or interruptions

We do not guarantee that the Service will be uninterrupted, secure, or error-free. You use the Service at your own risk.

8. Limitation of Liability

In no event shall Lumaqi, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content
Data loss or corruption during synchronization

Our total liability to you for all claims arising from the use of the Service shall not exceed the amount you paid us in the past twelve months, or $100, whichever is less.

9. Indemnification

You agree to defend, indemnify, and hold harmless Lumaqi and its licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Data Backup

While the Service is designed to help you backup your data, we strongly recommend maintaining independent backups of your important files. We are not responsible for any data loss that may occur during synchronization or due to Service malfunction.

11. Service Modifications and Termination

We reserve the right to:

Modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice
Refuse service to anyone for any reason at any time
Terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Lumaqi regarding the Service and supersede all prior agreements and understandings, whether written or oral, regarding the Service.
